2010 to 2018. Studies on the Improvement of the Regulation of Bankruptcy and Restructuring for Chinese Enterprises

The Foundation funded the Bankruptcy Law and Restructuring Research Center (BLRRC) of China University of Political Science and Law and other experts to undertake policy research projects on improving the management system for the reorganization of bankrupt listed companies. The research project studied relevant international experiences, and their adaptation to Chinese conditions, on issues such as: who or which authority (the courts?) should appoint the manager (administrator) for reorganising a bankrupt listed company; and the powers, responsibilities and necessary professional qualifications of the manager responsible for the reorganisation process. The final research outcomes have been submitted to the Supreme People's Court and other related departments. The study has promoted the establishment and improvement of the bankruptcy reorganization management system of listed companies.

 

In order to meet the demand of China's Supreme Court, in 2015, the Bankruptcy Law and Restructuring Research Center of the China University of Political Science and Law undertook the study on legal regulation reform of China bankruptcy and restructuring in the context of economic structure transition based on the result of previous study “management system for the reorganization of bankrupt listed companies”. This study, also supported by the Foundation, took consideration of new issues, new challenges and new environment to provide theory and practice support to the re-formulation of legal regulation on bankruptcy and restructuring of enterprises.

 

The People's Bank of China (PBOC) and the China Banking and Insurance Regulatory Commission (CBIRC) entrusted the Bankruptcy Law and Restructuring Research Center (BLRRC) of the China University of Political Science and Law and Integrity Financial Consulting to organize a high-level and small scale international workshop based on the study results of the research projects on “reform and improve the regulation of bankruptcy and restructure”. The Workshop was funded and co-organised by the Cairncross Foundation. The purpose of the workshop was to share international experience based on the actual context of China and to make recommendations for reforming and improving effective implementation of the regulation of bankruptcy and restructuring which can allow the Regulation to play a positive role in China economic structure reform. The results and recommendations of the workshop were submitted to PBOC, CBIRC and other relevant government departments.
